Service Terms & Conditions for Waste Collection Mayfair

These Terms and Conditions set out the basis on which Waste Collection Mayfair provides waste collection and related services to domestic and commercial customers. By making a booking, confirming a quotation, or allowing our operatives to commence any waste collection, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these Terms and Conditions, you must not place an order or use our services.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, business, or organisation requesting or receiving services from Waste Collection Mayfair.

Services means any waste removal, waste collection, clearance, loading, transportation, recycling, disposal, or related services provided by Waste Collection Mayfair.

Waste means any items, materials, or refuse that the Customer requests to be collected or removed as part of the Services, whether domestic, commercial, or construction related, excluding any items categorised as prohibited or hazardous under these Terms and applicable law.

Contract means the agreement between the Customer and Waste Collection Mayfair incorporating these Terms and Conditions.

Site means the address or location where the Services are to be performed.

2. Scope of Services

Waste Collection Mayfair provides scheduled and one-off waste collection and removal services, including but not limited to general household waste, commercial waste, bulky items, and non-hazardous construction or refurbishment waste.

The specific scope of Services, including the type and approximate volume of waste to be collected, the date and time window, and any special access or handling requirements, will be agreed at the time of booking or as confirmed in writing by Waste Collection Mayfair.

Waste Collection Mayfair reserves the right to refuse to collect any items that are unsafe, prohibited by law, classified as hazardous, or which cannot reasonably be handled by our operatives or vehicles.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through any online booking system made available by Waste Collection Mayfair. The Customer is responsible for providing accurate and complete information when making a booking, including:

a. Full contact details of the Customer.

b. Exact collection address and any access details.

c. Description and estimated volume or weight of the waste.

d. Any time constraints or site restrictions such as parking limitations or loading restrictions.

3.2 Any quotation provided prior to arrival is based on the information supplied by the Customer. If, upon arrival at the Site, the actual volume, type or nature of the waste differs materially from that described by the Customer, Waste Collection Mayfair may adjust the price, change the service level, or refuse collection of some or all of the waste.

3.3 A booking is only confirmed when Waste Collection Mayfair issues a confirmation by email, text, or other written method, or when a time slot is expressly agreed at the end of a telephone booking.

3.4 Waste Collection Mayfair will use reasonable efforts to attend within the agreed date and time window, but timing is not guaranteed. Time shall not be of the essence for the performance of the Services, and Waste Collection Mayfair shall not be liable for minor delays caused by traffic, access issues, adverse weather, or other events beyond its reasonable control.

4. Access and Site Conditions

4.1 The Customer must ensure that Waste Collection Mayfair has safe, suitable, and unhindered access to the Site and to the waste to be collected at the agreed time.

4.2 The Customer is responsible for obtaining any necessary parking permissions, permits, or loading consents required for the vehicle and operatives to attend and carry out the Services. Any fines or penalty charges incurred due to inadequate permissions may be charged to the Customer where they arise from the Customer's failure to arrange adequate access or provide accurate information.

4.3 The Customer must ensure that the waste is reasonably accessible, safely presented, and not mixed with hazardous substances or materials that are prohibited from the regular waste stream. Waste Collection Mayfair may refuse to handle items deemed unsafe or in breach of these Terms and Conditions.

4.4 If Waste Collection Mayfair attends the Site but is unable to carry out the Services due to lack of access, unsafe conditions, parking issues, or inaccurate information provided by the Customer, Waste Collection Mayfair may charge a call-out fee or a cancellation charge in accordance with the cancellation provisions in these Terms and Conditions.

5. Pricing and Quotations

5.1 Prices for Services are generally based on the volume, weight, and type of waste, as well as access conditions and service requirements. Waste Collection Mayfair may provide guide prices or estimated price ranges at the time of booking.

5.2 Any quotation provided before inspection of the waste is an estimate only. The final price will be confirmed on site once operatives have inspected the waste and access conditions. The Customer will be informed of any change to the estimated price before the Services are carried out.

5.3 Where additional Services are requested on site, such as the removal of extra items or clearing of additional areas, these may incur additional charges which will be confirmed before proceeding.

5.4 All prices are stated in pounds sterling and, unless expressly stated otherwise, are inclusive of standard rate VAT where applicable.

6. Payment Terms

6.1 Payment is due on completion of the Services, unless otherwise agreed in writing in advance. Waste Collection Mayfair may require payment in full or a deposit prior to attending the Site or before commencing work.

6.2 Payment may be made by cash, card, bank transfer, or any other method notified as acceptable by Waste Collection Mayfair from time to time.

6.3 For commercial or account Customers, alternative payment terms may be agreed in writing. In the absence of such agreement, all invoices shall be payable immediately on receipt.

6.4 If the Customer fails to pay any amount due, Waste Collection Mayfair reserves the right to charge interest on overdue sums at the statutory rate together with any reasonable costs incurred in pursuing payment.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by contacting Waste Collection Mayfair as soon as possible and no later than 24 hours before the agreed collection time, unless otherwise stated at the time of booking.

7.2 If the Customer cancels within 24 hours of the agreed time, Waste Collection Mayfair reserves the right to charge a reasonable cancellation fee to cover administrative costs and any loss of opportunity to allocate the booking slot to another customer.

7.3 If operatives attend the Site and are unable to carry out the Services due to reasons attributable to the Customer, including but not limited to lack of access, unsafe conditions, incorrect address, or unavailability of the Customer when required, Waste Collection Mayfair may treat this as a late cancellation and charge an appropriate fee.

7.4 Waste Collection Mayfair reserves the right to cancel or reschedule a booking where necessary due to operational reasons, vehicle breakdowns, staff illness, severe weather, or other circumstances beyond its reasonable control. In such cases, the Customer will be offered an alternative appointment or a refund of any prepayments made for Services not performed.

8. Customer Responsibilities

8.1 The Customer is responsible for ensuring that:

a. All waste to be collected is clearly identified.

b. No prohibited, hazardous, or illegal items are included in the waste, unless expressly agreed and permitted under relevant regulations.

c. Access to the Site is safe, lawful, and suitable for the type of vehicle and operatives required.

8.2 The Customer warrants that they either own the waste or are authorised by the owner to arrange for its removal and disposal.

8.3 The Customer must inform Waste Collection Mayfair in advance of any special considerations, such as fragile structures, restricted access points, or any known risks that might affect safe provision of the Services.

9. Prohibited and Hazardous Waste

9.1 Waste Collection Mayfair does not normally collect hazardous, controlled, or specialist waste, including but not limited to asbestos, chemicals, solvents, medical or clinical waste, pressurised containers, explosive materials, or any substances designated as hazardous under UK law, unless specifically agreed and appropriately licensed.

9.2 If hazardous or prohibited waste is discovered among the items presented for collection, Waste Collection Mayfair may refuse to handle such items, adjust the price to reflect specialist handling, or terminate the Service entirely. Any additional costs or legal liabilities arising from undisclosed hazardous or prohibited waste may be charged to the Customer.

10. Waste Handling and Environmental Compliance

10.1 Waste Collection Mayfair will transport and dispose of all collected waste in accordance with applicable UK waste management regulations and duty of care obligations. Waste will be taken only to authorised facilities for reuse, recycling, recovery, or disposal.

10.2 Upon collection, ownership of the waste transfers to Waste Collection Mayfair, subject to any applicable law. However, the Customer remains responsible for any breach of law caused by the contents of the waste if such breach arises from materials the Customer has presented for collection in contravention of these Terms or applicable regulations.

10.3 Waste Collection Mayfair seeks to maximise recycling and responsible waste management but does not guarantee that any particular proportion of waste will be recycled. The method of disposal will depend on the nature of the waste, local facilities, and legal requirements.

11. Liability and Limitations

11.1 Waste Collection Mayfair will exercise reasonable care and skill in providing the Services. However, the Customer acknowledges that waste collection and removal can involve the movement of heavy or bulky items, use of vehicles close to property, and handling of mixed materials.

11.2 Waste Collection Mayfair shall not be liable for any damage to driveways, access roads, pavements, underground services, or surfaces at the Site arising from the weight or movement of vehicles or the normal performance of the Services, provided that reasonable care is taken and the Customer has requested or permitted vehicular access.

11.3 Waste Collection Mayfair shall not be responsible for loss or damage to items that the Customer did not clearly separate from waste or that were reasonably believed by operatives to be waste. The Customer must remove or clearly mark any items not intended for removal.

11.4 Nothing in these Terms and Conditions shall limit or exclude Waste Collection Mayfair's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be limited or excluded under applicable law.

11.5 Subject to the preceding clause, Waste Collection Mayfair's total liability to the Customer arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the specific Services giving rise to the claim.

12. Indemnity

The Customer agrees to indemnify Waste Collection Mayfair against all claims, losses, damages, costs, and expenses arising from:

a. The inclusion of prohibited, hazardous, or illegal items in the waste.

b. Any breach by the Customer of these Terms and Conditions.

c. Any false statement by the Customer as to ownership or authority to dispose of the waste.

13. Data Protection and Privacy

13.1 Waste Collection Mayfair will collect and process personal information about Customers only to the extent necessary to manage bookings, provide the Services, handle payments, and administer customer relationships.

13.2 Personal data will be handled in accordance with applicable data protection laws in the United Kingdom. Information may be retained for a reasonable period for accounting, regulatory, and record-keeping purposes.

14. Complaints

If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Collection Mayfair as soon as possible with full details of the concern. Waste Collection Mayfair will investigate complaints and aim to resolve issues promptly and fairly.

15. Variations

Waste Collection Mayfair may amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that Contract. Updated Terms may be published or otherwise notified to Customers as appropriate.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

17. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful, or unenforceable, such provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.

18. Entire Agreement

These Terms and Conditions, together with any written confirmation, quotation, or booking details issued by Waste Collection Mayfair, constitute the entire agreement between the Customer and Waste Collection Mayfair in relation to the Services and supersede any prior understandings, representations, or agreements, whether oral or written.

By placing an order, making a booking, or permitting Waste Collection Mayfair to commence work, the Customer confirms that they have read, understood, and agree to these Terms and Conditions.
